A third federal appeals court has now rejected the Trump administration’s push to detain the vast majority of immigrants facing deportation without offering a bond hearing. The 6th Circuit Court of Appeals, based in Ohio, ruled Monday that detainees, including those who have lived quietly in the U.S. for years or decades, must have an opportunity to argue for their release before an immigration judge. The decision follows similar rulings from the 11th Circuit in Atlanta and the 2nd Circuit in New York, while the 5th and 8th Circuits have sided with the administration. The issue is widely expected to reach the Supreme Court.
At the center of the dispute is how to interpret a 30-year-old immigration statute requiring mandatory detention for “applicants for admission.” For decades, that language was applied only to people who had recently arrived at the border, not those already living in the country’s interior. Last July, ICE reversed course, declaring that anyone targeted for deportation, regardless of how long they had been in the U.S., would be treated as an “applicant for admission” and held without bond.
These rulings carry real consequences for real people. Immigrants detained under this policy have no opportunity to tell a judge about their lives, their families, or their ties to their communities before they are locked up. That is not just a legal question; it is a matter of basic fairness and due process.
